The words "open source" come from the fact that this software is comprised of a loose set of principles and practices on how to write your own software. Basically, this means that the source code is available to anyone; and anyone has the right to use it, modify it, enhance it, and eventually re-distribute it as another form of software.
OSS then, under the open source license, is also available to anyone who wishes to study it, change it and improve its design for personal use. In short, there are no intellectual property rights for the kernel of the software itself.
